overhead materials for its own use, and also for the purpose
of constructing or relaying tracks for other railway
companies under the franchises owned by them, and to con-
struct said tracks and overhead work, and to sell said rails,
ties and other track material when used in such track con-
struction, either absolutely or to conditionally deliver pos-
session thereof to the purchaser, reserving by written
contract the title thereto until all payments due thereon are
paid, or to lease the same to said other railway companies
on such terms as may be agreed upon; and all such contracts
of conditional sale or of lease shall be executed and recorded
as provided by Section 87 of Article 21 of the Code of Public
General Laws of Maryland, and shall be subject to all the
terms thereof; provided, that before the said company shall
construct any track along any public highway in any of the

counties aforesaid, it must obtain the consent of the County
Commissioners of the county in which it desires to so con-
struct its tracks to such use of said highway, and before the
said company shall construct any track or tracks upon any
of the streets of the city of Baltimore, it must obtain the
consent of the Mayor and City Council of Baltimore to such
use of any street, and before the said company shall construct
any track or tracks upon any of the streets of any munici-
pality in the counties aforesaid, it must obtain the consent
of such municipality to such use of any streets; and the
right of said company to construct and operate said railway
upon the streets of the city of Baltimore shall always be
subject to all provisions, requirements and limitations con-
tained in Chapter 123 of the Acts of the General Assembly
of Maryland of 1898, known as the charter of the city of
Baltimore, and all amendments thereto.
SEC. 2. And be it further enacted, That this Act shall take
effect from the date of its passage.

CHAPTER 247.

AN ACT to repeal and re-enact with amendments, Section
62 of Article 1 of the Code of Public Local Laws of
Maryland, entitled " Allegany County," sub-title " Cum-
berland," as repealed and re-enacted by Chapter 56 of the
Acts of 1892 of the General Assembly of Maryland.
