80. Any person violating the foregoing section shall be
deemed guilty of a misdemeanor and on conviction thereof
before any justice of the peace of Anne Arundel county shall
pay a fine of one dollar for each and every partridge, quail,
pheasant, woodcock, robin, thrush, oriole, snipe or plover
shot, caught or taken or sold, offered for sale, exposing for
sale, or carried out of the limits of said county, together with
costs of proceedings, and shall pay a fine of one dollar and
costs for every rabbit, squirrel or muskrat shot, killed,
caught or carried out contrary to the aforegoing section, and
five dollars for every raccoon shot, killed, caught or carried
out contrary to the foregoing section. The possession by
any person within the said county of any of the birds or
animals mentioned in the preceding sections at any time
during which said possession is prohibited by said sections
shall be prima facie evidence of the violation thereof, and the
presence of any person in the field or on any public road
accompanied by a dog and with gun in hand during the
closed season of partridges, pheasants, quail and woodcock,
as provided above, shall be considered as prima facie evi-
dence of such violation.

CHAP. 689

Penalty for
violation of
law.

SEC. 2. And be it enacted, That a new section be and is
hereby added to said Article, to come in after Section 80,
and to be known as Section 80 A, to read as follows :
80 A. Any owner who shall permit his dog or bitch to run
at large during the closed season and pursue or kill game, or

destroy the eggs, nests or young thereof shall be deemed
guilty of a misdemeanor and be subject to a fine of one
dollar for each and every offense, one-half to go to the
informer, or imprisonment in jail for three days, in the dis-
cretion of the court or justice imposing the fine or sentence;
any person who shall harbor or permit any dog or bitch to
remain on or about his premises shall be deemed the owner
of such dog or bitch for the purposes of this section.
SEC. 3. And be it enacted, That this Act shall take effect
from the date of its passage.
