CHAP. 404.

mentis, or out of the county in which this property may lie
when such lands or materials may be needed, the said com-
pany may proceed to condemn and require the same for the
.use thereof for the purpose of said railroad, or for the pur-
pose of the motive power thereof, in the manner provided for
by the general laws of this State as now in force, or as they
may be hereafter enacted, so far as the same may be applicable,
and may condemn land, easements, rights, ways, materials and
privileges for the purposes of the company in the manner afore-
said, and shall have all other rights, privileges and power
which are granted by the general laws, as far as the same does
not conflict herewith.

Books for
subscription
opened.

SEC. 7. And be it enacted. That the said board of direc-
tors are hereby authorized to open books for subscriptions to
the capital stock of the said railroad company at such times
and places as they may deem proper ; that the said board of
directors shall have power to determine what instalments said
subscription to said capital stock shall be paid.

Notice to be
given for an
election.

SEC. 8. And be it enacted, That should any or a majority
of the citizens in any incorporated towns through or by whicn
the aforesaid railroad may pass, or to which it may extend,
desire that such towns subscribe to the capital stock of this
incorporation to an amount not to exceed ten thousand dollars
for the building or equipment of the aforesaid railroad, that
upon the presentation of a petition signed by a majority of the
citizens of such towns to the Mayor and Town Councilmen,
expressing such desire, the Mayor of such town shall give
notice for an election to be held in the same manner as other
elections are held in such towns for the purpose of determining
if such towns as beforesaid shall subscribe the said capital
stock in an amount, or part of the amount as aforesaid, and in
case the result of such election shall be in favor of such sub-
scription, then the Mayor and Council, or a majority of them,
shall determine what amount shall be so appropriated ; and the
Mayor and Councilmen shall at once cause to be issued bonds
in the same manner as bonds are issued or may be issued for
their improvements of such towns, at whatever rate or interest
the majority of such Councilmen may deem judicious and
proper, and all such bonds so issued shall be sold as soon as
possible and the proceeds appropriated as aforesaid.

Authority to
extend its
lines, etc.

SEC. 9. And be it enacted, That the said railroad company
shall have and is hereby given power to extend its line or lines
or construct its roads upon any public highway or road in
Frederick county ; providing, it first has and obtains the con-
sent and approval of the Board of County Commissioners for
said Frederick county, and shall have the power to extend or
