CHAP 356.

Provide for
codification
of ordinances
passed and
printing
of same, etc

copy of all euch ordinances, when approved by the Mayor and
Council, shall be legal evidence of the passage of such ordi-
nance and of the contents thereof, in any Court in this State;
to provide penalties not exceeding twenty-five dollars in
amount, or a term of imprisonment not exceeding thirty days,
for the violation of ordinances, or both fine and imprisonment.
The Town Council shall not borrow money nor incur debts,
nor issue bills or other securities of a commercial character, in
excees, in any year, of the receipts of the annual levy. The
Council shall have full power to grant franchises for the public
utility essential to the proper service of said town of Midland ;
but any franchise granted by said town shall be and remain
subject to recall and resumption by said Council, and to pur-
chase, including all the property and appurtenances and
belongings, by said Council, at any time, upon six months'
notice, at a cost not to exceed the cost of construction or dupli-
cation of the physical property involved, plus a sum of ten per
dent, upon said cost, the same to be determined by a vote of
the Council, to be ratified by a vote of the qualified electors
of said town, and any franchise granted shall be construed in
law to contain and be accepted upon the above conditions.

CLERK.

Clerk.

The clerk, before entering upon his duties, shall take the
oath herein prescribed for members of the Council, and shall
execute such bond as may be prescribed by ordinance. He
:fihall countersign all orders for the payment of money, and in
the absence of the Mayor become Mayor pro tem., the Council
appointing one of their body to till the place of clerk; be
shall keep a full and accurate set of accounts of the town
records and papers; he shall keep a journal of the proceed-
ings of the Town Council, which shall be open at all times for
inspection of any citizen, and in a well-bound book shall enter
a copy of the oath taken and therein subscribed by every
elected officer of the town, with the witness thereto. He shall
receive such compensation as the Council may provide.

TREASURER.

Treasurer,

The Treasurer shall, before he enters upon his duties, take
the oath prescribed for members of the Council and execute a
bond in such conditions and for such amount as may be pre-
scribed by ordinances of the corporation, issued by some
responsible Maryland bonding corporation. He shall have the
custody of all corporation funds, and shall pay out the same
only upon orders of the Council, signed by the Mayor and
countersigned by the clerk. He shall receive such compensa-
tion as the Council may provide.
