by the Council, and any order drawn upon the treasurer shall
so state, with the date of passage by the Council. The Mayor
and Council of Midland shall have power to pass all ordi-
nances necessary for the good government of the town ; to
prevent, remove and abate all nuisances or obstructions in or
upon the streets, highways, lands or alleys, drains or water
courses, or in or upon any lot or lots adjacent thereto ; to make
reasonable regulations in regard to buildings to be erected in
said town, and to grant building permits for the same ; to
make and establish grades upon the highways and streets of
the town ; to cause sidewalks, kerbs and gutters to be laid,
paved, repaired or improved along the streets or highways of
said town at the cost and expense of the abutting property or
the owners thereof; to cause the water courses, drains or
sewers of the town to be kept in repair and cleansed ; to regulate
sales in the streets, alleys and public places of said town and
regulate and provide for the licensing of peddlers, hawkers
and venders of merchandise and patent medicine and traveling
circuses and shows of any description ; to establish and regu-
late a station house or lock-up for temporary confinement of
violations of the laws and ordinances of the town ; to suppress
vagrancy ; to open and close streets, roads, lanes and alleys
and establish footways when in their judgment the public
welfare or convenience may require ; to provide for ascertain-
ing whether any and what amount in damages will be caused
thereby for which the owner or possessor of any property
through which such street, road, lane or alley may pass ought
to be compensated ; to provide for granting appeals to the
Circuit Court of Allegany County from the decisions of any
commissioners or other persons appointed in virtue of any
ordinance ; to ascertain the damage occasioned by opening,
closing or establishing or altering of streets, roads, lanes or
alleys in said town and for securing to the person injured the
right, on application within thirty days from the return of the
commissioners, to have decided by a jury trial whether any
and what damages he has sustained ; to provide for collecting
and paying the compensation awarded to any person before
any street, road, lane or alley shall be opened, closed, estab-
lished or altered, and to enact all ordinances from time to
time necessary and proper to the exercise of the power granted
in this section ; provided, that whenever the Council propose
to open, close, alter or establish any street, road, lane or alley
they shall give at least thirty days' notice by advertisement or
handbills to all parties interested of their intention and the
time of consideration of such action ; to provide for the
codification of all ordinances that may be passed, and
the printing and publishing of the same, and the printed
