BAILIFF.
The Bailiff shall, before entering upon his duties, take the
same oath as the members of the Council and execute a bond
for the faithful performance of his duties in some responsible
Maryland bonding corporation, with conditions and amount
such as the Council may by ordinance prescribe. He shall
perform the police duties of the town, and is clothed with the
powers of a constable, under the general law. He shall be
subject to the orders of the Mayor and Council ; shall collect
all taxes and other claims, tines and assessments that may be
due the town, and shall pay over and account for the same at
sch time and in such manner as may be prescribed by ordi-
nance of the Council. He shall receive a salary of forty
dollars monthly for his services as bailiff and such commission
not exceeding five per cent, upon the moneys collected by
him when collected as the Council may determine.

Bailiff.

The Board of Health — which is composed of a member of
the Council elected by their own body as hereinbefore pro-
vided, the bailiff by virtue of his office and one person who
shall be secretary, and shall be a physician elected by the
people at the same time as the Mayor and continuing in office
for one year from the first Monday in May next succeeding
his election or, until his succcessor has been elected and
qualified — shall have such power and duties as may be delegated
to them by the Council by ordinance for the care of the
health of the people and the removal of nuisance and the
prevention or spread of dangerous and contagious diseases.
The secretary of the board shall receive compensation as the
Council may determine.

RATIFICATION.

Board

At the election on the fourth Monday in April, nineteen
hundred and two, provided for in this Act, each voter shall
have written or printed on his ballot the word "For incorpora-
tion" or "Against incorporation," and if a majority of the
votes catt at said election shall be in favor of incorporation,
then the provisions of this Act shall take effect and the elec-
tion thereunder shall be valid ; but if a majority of the votes
so cast shall be against incorporation, then this Act shall be
held mill and void for a period of one year or until the fourth
Monday in April, nineteen hundred and three, when the
qualified voters of the said town may again assemble and vote as
hereinbefore provided; and if at the second election a majority
of the qualified voters of said town shall vote for incorpora-
tion, then the provisions of this Act shall take effect and the
