CH A P. 365.

from the shore line of Middle or Lower Hooper's Island,
Dorchester county, nor place a booby or stationary blind
within 200 yards of the shore.

Penalty
for violation

Section 337. Any person or persons violating the provisions
of sections 335 and 336 of this Act shall, upon conviction
thereof before any justice of the peace of said county, forfeit
and pay the sum of twenty-five dollars and costs, and also
forfeit the boat or boats, gun or guns and net or nets used in
said violation. And for every subsequent violation of the two
preceding sections a fine of fifty dollars and costs shall be
imposed, together with the forfeiture of the boat or boats,
gun or guns and net or nets employed in said violation.
The said fines to be imposed and recovered before any
justice of the peace within the said county of Dorchester,
and in default of the payment of the said tine the person or
persons so convicted, shall be committed to the house of cor-
rection or the county jail for a period of not less than ten nor
more than thirty days for each offense ; the boat or boats, gun

or guns and net or nets captured and forfeited under the pro-
visions of this section, shall be immediately advertised by the
justice for sale, by printed or written notice posted at the
office of the justice and at two other prominent places within
one mile of the place of sale. Said sale shall be made at ten
days' notice, and the said boat or boats, gun or guns and net
or nets shall be sold at public sale or auction, to the
highest bidder for cash, and the money arising from said sale
and fines after the deduction of legal costs of the justice or
other tribunal before whom said offender or offenders shall be
convicted, shall be divided and paid one-half into the free
school treasury of Dorchester county for the use of said school,
and the other half to the person or persons prosecuting said
offenders and securing their conviction ; provided, nothing
herein contained shall prevent any person or persons who may
be grieved by the decision of the justice of the peace before
whom said person or persons might appear on the charge of
violating either of the two of the aforesaid sections from
appealing from the judgment of the said justice to the Circuit
Court of Dorchester County, if such appeals are taken and
satisfactory bond filed for prosecuting said case, which bond
shall cover fully the value of the boat or boats, gun or guns
and net or nets seized, together with all fines imposed and all
the costs of the case ; the bond to be filed with the justice of
the peace within tive days after the conviction of said person
or persons.

Section 338. It shall not be lawful for any person or per-
sons not a bona fide resident or taxpayer of Dorchester county
