possessed by justices of the peace or which may be hereafter
conferred upon them by law, and all violations of any of the
ordinances of the town of Chestertown, subject however, to
the same right of election to be tried by jury, notice of which
must be clearly given by said justice to the party before
beginning trial, and subject to the same right of appeal as
now exists under the law ; provided, however, that nothing
contained in this Act shall preclude the said police justice from
trying criminal cases which arise in any other district of said
county, if the same shall be properly brought before him, by
consent of the State and the party charged.

CHAP 161.

138 B. That the said police justice shall receive as compen-
sation for his services the sum of four hundred dollars ($400)
per annum, or the proportionate part thereof, so long as he
shall continue to act as such police justice in said district;
said salary to be paid by the County Commissioners of Kent
county in equal quarterly instalments, and this salary shall be
in full compensation for all services required of him under
this Act ; and no justice of the peace so selected for police
justice shall be permitted to charge any fee or receive a
gratuity for making any commitment, granting any release,
or for the performance of any duty required by law in
criminal cases.

138 C. That if any justice 'of the peace so selected as a
police justice is unable, by reason of sickness, absence, rela-
tionship, or for any other temporary cause whatever, to attend
to his duties as such police justice, it shall be the duty of the
State's Attorney for said county to designate and require
appther justice of the peace to perform the duties of said
police justice, so sick, absent or otherwise unable to perform
the duties of his said office, so long as the same may be neces-
sary, or until the Governor shall select another to perform
said duties, and the said State's Attorney .shall forthwith
certify ,in writing any selection he may make to the County
Commissioners of Kent county. The jostled so required to
perform said duties as police justice shall receive the same
compensation as prescribed by law for the police justice and
shall be paid by the County Commissioners, who snail deduct
the same from the salary of the police justice.

138 D. That it shall be lawful for any justice of the peace
of Kent county, where the police justice is not accessible, to
issue a State writ for the arrest of any person, violating any
of the laws of this State, or any ordinances of the town of
Chestertown ; but when issued by any justice of the peace
other than the police justice said writ shall be made return-
