of such land or material, or any improvements for the con-
struction or repairs of said railway or its works, for the pur-
chase or use and occupation of the same; and in case they do
not agree, or if the owner or owners, or any of them, be feme
covert, under age, non compos mentis, or out of the county in
which the property may lie, when such lands or materials may
be needed, the said company may proceed to condemn and
acquire the same or the use thereof, for the purposes of said
railway, or for the purposes of the motive power thereof in
the manner provided for by the Code of Public General Laws
of Maryland, article 23, sections one hundred and sixty-nine
and one hundred and seventy- three, so far as the same may be
applicable, and may condemn land, easements, rights of way,
crossings, materials and privileges for the purposes of the
company, in the manner aforesaid, and shall have all other
rights, privileges and powers, which are granted by the
general laws of Maryland, for the incorporation of passen-
ger railways or railroads, so far as the same do not conflict
herewith.

SEC. 4. And be it enacted, That said company shall have the
right to carry for hire, express matter and merchandise.

from the date of its passage.

CHAPTER 420.

AN ACT to authorize and empower the Mayor and City Coun-
cil of Havre de Grace to contribute to the cost of erecting
a public school building in the city of Havre de Grace, and
to issue bonds to raise the money necessary for that purpose
and to repair the public buildings of said city.

Effective.


SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Mayor and City Council of Havre de Grace are
hereby authorized and empowered to contribute for the erection
of a public school building in the city of Havre de Grace, a
sum not exceeding seven thousand five hundred dollars, when-
ever the County Commissioners of Harford county or the
Board of School Commissioners of Harford county, shall have
purchased a site in the city of Havre de Grace, and shall have
contracted for the erection and furnishing of a public school
