conviction before a judge of the Circuit Court or a justice of
the peace having jurisdiction, be fined a sum of not less than
fifty dollars nor more than one hundred dollars, or committed
to the House of Correction for a period of not less than three
months nor more than six months, or both, in the discretion of
the judge or justice of the peace trying the same; and in case
a fine is imposed under the provisions of this section, said fine
to be paid over by the officer making the arrest, to the Comp-
troller of the State, to be credited to the oyster fund; one-half,
however, to be paid to the informer.

CHAPTER 419.
AN ACT to amend the charter of The Hagerstown Railway
Company of Washington County, Maryland, so as to confer
upon said company the power to borrow money, to exercise
the right of condemnation, and to carry for hire, express
matter and merchandise.
SECTION 1. Be it enacted by the General Assembly of Mary-

of Washington county, Maryland, a corporation duly incorpo-
rated under the general incorporation act for the formation of
companies, be and the same is hereby amended as follows :

SEC. 2. And be it enacted. That the board of directors of
said company shall have power to issue, in the name of said
company, bonds to an amount sufficient, in the judgment of
said directors, to complete and fully equip said railway and
secure the payment of said bonds by mortgage of all or any
part of the property, rights, franchises, tolls and revenues of
said company.

SEC. 3. And be it enacted, That the said company may
cause to be made or contract with others for making said rail-
way tracks, switches, turnouts, branches, power houses and
trolleys, or any part thereof, including the building of bridges,
necessary warehouses, depots and stations, and all work what-
soever, which may be necessary to the proper completion and
working of said railway and branches, and may acquire any
land, earth, stone, gravel or other material required for any of
the purposes aforesaid, by agreement with the owner or owners
