10 A, That all orders for money drawn by the County Com-
missioners of Calvert county for out-door pensioners, shall be
paid by the Treasurer of Calvert county in preference to any
other claims, so far as the funds in his hands will permit.

Out-door

SEC. 2. And be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 415.

AN ACT to repeal Section 138 of Article 20 of the Code of
Public Local Laws, title "Somerset County," sub-title "Liquor
and Intoxicating Drinks," as repealed and re-enacted by
chapter 257 of the Acts of the General Assembly of Mary-
land, passed at its January session, 1890, and to re-enact the
same with an amendment, so as to include Election district,
No. 4 within the provisions of said section.

SECTION 1. Be it enacted by the General Assembly of Mary-

Local Laws, title " Somerset County," sub title " Liquor and
Intoxicating Drinks," as repealed and re-enacted by chapter 257
of the acts of the General Assembly of Maryland of 1890, be,
and the same is hereby repealed, and re-enacted with an amend-
ment, so as to read as follows :

Repeal.

138. It shall not be lawful for any person or body corporate
in Election districts, Nos. 1, 3, 4, 6, 7, 8, 10 and 11, of Somer-
set county, to sell intoxicating, spirituous or fermented liquors,
except cider and home-made wines, on the premises where
manufactured in quantities not less than one gallon, and any
person violating the provisions of this section shall, upon indict-
ment and conviction therefor, be fined not less than $100 nor
more than $200, and be imprisoned in the county jail sixty days
for each and every offense; and it shall be the duty of any jus-
tice of the peace, upon information deceived and confirmed by
the oath of a creditable witness, to have any person violating
any of the provisions of this section, arrested and committed
to the county jail unless he shall give sufficient bail or recog-
nizance with sureties to be approved by said justice to appear
before the Circuit Court at the next succeeding term thereof to
answer said charge.
