38. It shall not be lawful to shoot, trap or kill, or in any
manner destroy or expose for sale, any partridge or rabbit in e
Cecil county, between the tenth day of January and the first
day of November, nor any woodcock, between the first day of
January and the tenth day of June, nor any rabbit or reedbird
or pheasant, between the first day of February and the fifth
day of September in each year in Cecil county; and the pos-
session of any of the birds or game mentioned in this section,
during the prohibited period, shall be deemed prima fade
evidence against such person of a violation of this section,
except when it may appear that such birds or game are for
breeding purposes.

SEC. 2. And be it enacted, That this act shall take,
effect from the date of its passage.

CHAPTER 238.

AN ACT to prohibit the sale or giving away of spiritueus or
fermented liquors or other articles of traffic within one mile
of Sunday School Picnics in Frederick County.

Effective.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That if any person shall erect, place or have any booth,
stall, tent, carriage, boat, vessel, or other vehicle or contrivance
whatever, for the purpose or use of selling, giving or otherwise
disposing of any kind of spirituous or fermented liquors, or
any other articles of traffic, or shall sell, give, barter or other-
wise dispose of any spirituous or fermented liquors or any
other articles of traffic within one mile of any Sunday School
picnic in Frederick county, during the time of the holding
thereof, such person on conviction before a justice of the peace
for the first offense, shall be fined not less than five nor more
than twenty dollars, and stand committed to jail until the fine
and costs are paid, and for the second offense shall be fined as
aforesaid, and be imprisoned not less than ten, nor more than
thirty days.

SEC. 2. And be it enacted, That the provisions of the pre-
ceding section shall not apply to any licensed tavern keeper,
merchant, shopkeeper, farmer, or other person in the usual and
lawful transaction of his ordinary business in the usual place of
transacting such business, or to any person having permission
in writting from the superintendent, or committee having charge
