CHAP. 58,

of the names of the persons benefited aforesaid, and the a-
mount assessed to them respectively, and the suras of money
so assessed and charged to each individual or company as
aforesaid, shall be a lien on the property so benefited.

Mode of collection

SEC. 3, And be it enacted, That the said several sums of
money so assessed and charged, shall be collected hy the col-
lector of the city of Baltimore, and shall forthwith be paid
over by him to the mavor and city council of Baltimore, and
by them to the person or pet sons entitled to receive the same,
and it shall be the duty of the collector of the city of Balti-
more, within thirty days from the time of his receiving the list
aforesaid, to give notice in one of the newspapers of the city of
Baltimore, to the persons respectively bound to pay the same,
that the amount so assessed and charged as aforesaid, must be
paid within twenty days from the day oi the giving said notice,
and should any sum or sums of money so assessed and charg-
ed us a fort said, not be paid within the time so limited for the
payment of the same, the collet tor of the city of Baltimore
bhall be, and he is hereby authorised to sell at public sale, for
cash, the whole or any part of the property on which such as-
sessment shall be made, first giving not less than thirty days
notice of such intended sale, in one of the newspapers printed
in the city of Baltimore; and the collector of the city of Balti-
more, upon receiving the purchase money of the property so-
sold, shall execute a deed or deeds oi: conveyance therefor in
favor of the purchaser or purchasers, which deed shall be
good and sufficient to pass the fee simple estate in the said
property; and the collector of the city of Baltimore aforesaid
after deducting from the amount of such sale or sales, the
amount assessed and charged as aforesaid upon the property
so sold, the cost of such sale or sales, the cost of advertising,
and three per cent commission to himself, in addition to the
commission hereinafter mentioned and allowed, shall pay over
the balance to the person of persons entitled thereto.

See, 4, And be it enacted, that each of the members of the
said board of commissioners, shall be allowed two dollars per
day for each day they are employed in the carrying into effect
the provisions of this law, and that the collector of the city of
Baltimore shall be allowed three per cent, on all sums collect-
ed by him under the provisions of this law, which per diem
and commissions are to be considerd as a part of the expense
necessary for the carrying of this law into execution, and are
to be assessed and levied as is herein before mentioned.

SEC, 5 And be it enacted, That the said alley bhall not be
considered as condemned or opened for a public highway, un-
til the damages to be by each person sustained and assessed as
aforesaid shall be first paid to the mayor and city council of
Baltimore, for the use of the pers6a or persons entitled to re-
ceive the same

SEC. 6 And be it enacted. That this act shall have no force
or validity until approved of by the mayor and city council of
