and it shall be, and is hereby made the duty of the said trea-
surer, whenever such license shall be revoked or forfeited un-
der this act, immediately to give public notice thereof, in two
or more public newspapers in the city of Baltimore.

SEC, 16. And be it enacted, That it shall be the duty of the
treasurer of the Western shore of this state, to transmit an-
nually, by mail or otherwise, to all auctioneers appointed by
virtue of this act, copies of all the existing laws of this state,
relative to sales at auction, and that it shall also b his duty

made by the said auctioneers for the half year preceding the
first days of January and July, pursuant to the provisions
of this act.

SEC. 17. And be it enacted, That if any auctioneer appoint-
ed under this act, shall accept at any time during the conti-
nuance of his appointment as such auctioneer, an appointment
as auctioneer from any other state, such auctioneer shall be
deemed to have forfeited his appointment as auctioneer undet
this act; and if any person shall be guilty of any fraud or de-
ceit in the execution of this act, or in eluding or defeating the
operation thereof, every such person shall on conviction

thereof, forfeit the sum of one thousand dollars as a penalty
for every such offence, to be recovered by any person who
will sue for the same, by action of debt or indictment in any
court having cognizance thereof, the one moiety thereof when
recovered,to be for the use of such person, and the other moiety
to be for the use of this state.

SEC. 18. And be it enacted, That if no person shall within
seven days after any offence shall be committed against this
act, prosecute for the penalties therein mentioned, it shall be
lawful for, and it shall be the duty of the treasurer of the
Western Shore, information thereof having come to his know-
ledge, to direct the attorney general to prosecute for the same,
which penalties when recovered, shall be paid to the said trea-
surer for the use of this state.

SEC. 19. And be it enacted, That if any person shall wilfully
swear, or affirm falsely, touching any matter herein before re-
quired to be verified by oath or affirmation, he shall suffer the
pains and penalties which by law are prescribed for wilful and
corrupt perjury, and if an auctioneer, shall forfeit his office.

SEC. 20. And be it enacted, That all laws inconsistent with
the provisions of this act, be, and the same are hereby repealed.

SEC 21. And be h enacted, That the sum of twenty thou-
sand dollars be, and the same is appropriated annually, to be
paid out of the proceeds of duties arising from sales at public
auction, for the purpose of deepening and improving the

proceeds of the said duties shall prove sufficient to meet and
discharge the said appropriation, and if insufficient, the same
to be limited to the nett proceeds of the said duties, subject to
the provisions hereinafter contained.
