CHAP. 91.
Removal of ob-
structions
|
9. And be it enacted. That if the obstructions in the Said
Monument-street, so opened, or to he opened, be not removed,
within thirty days after the payment, or tender of payment of
damages as aforesaid, or after the consent of the proprietor or
proprietors be given in writing, said commissioners shall have
full power and authority to cause all such obstructions to be re-
moved at the expense of the city, and to sell and dispose of the
materials of such buildings, or obstructions, for the benefit of
said city.

Compensation
of commissioners

10. And be it enacted. That the said commissioners shall
receive, as a compensation for their services, two dollars per
day for every day they may act, which compensation shall be
paid by the said mayor and city council, as part of the expenses
of opening said street, and which shall be assessed and collect-
ed in manner aforesaid.

Damages to be
paid in thirty day
|
11. And be it enacted, That the said mayor and city coun-
cil shall pay, or tender in payment, to the parties entitled to
receive the same, the damages sustained, or which shall be sus-
tained, by any person or persons, by reason of or on account
of the opening the said street, as the same may be assessed or
ascertained by said commissioners, within thirty days after the
lists made out by the said commissioners, (in conformity with
the provisions of the third section of this act, ) shall have been
deposited in the office of the register of the city of Baltimore.

12. And be it enacted, That in case any person or persons,
on whose property is assessed any sum or sums of money, shall
voluntarily pay the same into the treasury of the city of Balti-
more, at any time before the expiration of thirty days after the
return of the said commissioners shall be made to the register
of the said city, (in the mode prescribed by the third section of
this act,) such person or persons shall be entitled to a deduction
of the commission which may have been allowed to the collec-
tor by the said commissioners, in virtue of the provision in the
said fifth section.

Part of a road
may be that up
|
13. And be it enacted, That the said commissioners shall
have full power and authority, and they are hereby authorised
and directed, to shut up, or cause to be shut up, all such parts
of a road known by the name of the Old Joppa Road, as they,
in their discretion, may think will be rendered useless or super-
fluous as a public road, in consequence of the opening of the
said Monument-street; and thereupon the said commissioners
are further directed to take into their consideration all damages
that may be incurred by, and all benefit that may accrue to, the
holder or holders of any property, by reason of the shutting up
of any part or parts of the said Old Joppa Road, and to assess
the same accordingly.

14. And be it enacted, That this act shall be of no force or
validity unless approved of by the mayor and city council of
Baltimore.
