vices, each county to pay such commissioner or commissioners
as may reside therein.
3. And be it enacted, That in case of the death, resignation
or refusal, of any of the aforesaid commissioners, the levy court
of Dorchester or Caroline county, as the case may be, may fill
the vacancy; that is to say, if such vacancy shall be occasioned
by the death, resignation or refusal, of either of the said com-
missioners residing in Dorchester, the levy court of that county
shall fill said vacancy, and if any vacancy shall be occasioned
by the death, resignation or refusal, of any one of the said
commissioners residing in Caroline county, then said vacancy
shall be filled by the levy court of that county.

CHAP. CLI.
An Act authorising Elizabeth R. Howard of Montgomery County, to convey a
certain Lot of Land therein mentioned.
WHEREAS the said Elizabeth R. Howard, hating, by her
bond and deed of mortgage, bound herself under a heavy penalty,
to convey a certain lot or parcel of land, part of a tract of land
called The Resurvey on Valentine's Garden Enlarged, and now
included in the first addition to Rockville: And whereas the le-
gal title of said land is vested in her daughter, Emily Howard;
Therefore,

make a deed upon
giving bond

1. Be it enacted by the General Assembly of Maryland,
That whenever the said Elizabeth R. Howard shall execute a
bond to the state of Maryland, to be filed and recorded in the or-
phans court of Montgomery county, in the sum of two hundred
and fifty dollars, with legal interest thereon from the twenty-
nixth day of May eighteen hundred and twenty five, to be paid
to the said Emily Howard when she shall arrive at the age of
twenty-one years, she the said Elizabeth R. Howard shall, at any
time thereafter, be authorised and empowered to make and exe-
cute a good and sufficient deed, in fee simple, to Samuel C.
Viers, the purchaser of said lot, or to his heirs or assigns, and
the grantee or grantees under the said deed, shall take and hold
the said lot, or parcel of land, free and clear of any claim of
the said Emily Howard, as if she were of full age and had con-
veyed the said lot to the said Samuel C. Viers, his heirs or as-

2. And be it enacted. That it shall be the duty of the clerk of
Montgomery county to record the said deed among the land re-
cords of said county.

CHAP. CLII.
An Act to change and alter the Names of David Trundle and Hezekiah
Trundle, sons of John T.. Trundle, of Montgomery County, to David Hen-
ry Trundle and Hezrkiah William Trundle.

1. Be it enacted by the General Assembly of Maryland,
That the name of David Trundle, son of John L. Trundle, of
Montgomery county, be and the same is hereby changed and
altered to the name of David Henry Trundle, and the name of
Hezekiah Trundle, son of the said John L. Trundle, be and^the
same is hereby changed and altered to the name of Hezekiah
William Trundle; and it shall and may be lawful for the said Da-
