CHAP. 129.

Proviso

lector of the county, for the use of the said county, subject to
the appropriation of the levy court; Provided always, that
nothing in this act contained shall authorise the destruction or
impounding any swine driven through the said town, and not
intended to be kept therein, or any swine the property of any
person or persons residing more than one quarter of a mile
from said village, unless the said swine shall be kept in said vil-
lage by a resident or residents thereof.

3. And be it enacted, That if any swine shall be impound-
ed under the provisions of this act, it shall be the duty of the
person so impounding them, to give notice thereof, by writing,
set up at the court-house door, describing the swine so im-
pounded, and if the owner shall not, within two days thereaf-
ter, prove his or her property therein, and make compensation
for the injury, (if any,) which may have been sustained by
any inhabitant of said town, to-be ascertained by two disinte-
rested inhabitants thereof, to be appointed by a justice of the
peace, and shall not pay for every hog the sum of fifty cents for
every day it shall have been impounded, it may be lawful for
the person so impounding to sell or kill the same for his or her
benefit.

4. And be it enacted, That if any person shall be sued for
killing or impounding any swine going at large as aforesaid, he
may plead the general issue, and give this act and the special
matter in evidence.

Annual appropri-
ation for improve-
ment of streets

CHAP. C XXX.

An Act for the improvement of the Town of Rockville, in Montgomery
County.

1. Be it enacted by the General Assembly of Maryland,
That the levy court of* Montgomery county be, and they are
hereby authorised and required, to appropriate a sum of money
annually for the improvement of the streets and lanes in the
town of Rockville, not exceeding one half the tax levied on the
assessable property in said town.

Trustees to be ap-
pointed

2. And be it enacted, That the said levy court shall annually,
in the month of April, appoint three persons, residents of said
town, to be denominated the trustees of Rockville, whose duty
it shall be to superintend the repairing and improvement of the
streets and lanes aforesaid.

3. And be it enacted, That the said trustees shall annually
report to the levy court aforesaid, an account of the expenditure
of the money received by them.

CHAP. CXXXI.

An Act for the relief of the Trustees of the Hagers-Town Academy.

1. Be it enacted by the General Assembly of Maryland,
That the treasurer of the western shore be and he is hereby au-
thorised and required, out of any monies in the treasury not
otherwise appropriated, to pay to the trustees for the time being
of the Hager's Town academy, or to their order, any sum or
sums of money not exceeding four thousand dollars, which may
in the opinion of the said treasurer have been advanced by the
said trustees, or by any other person or persons, before the
