1. Be it enacted by the General Assembly of Maryland,
That Thomas Oliver and Alien Thomas, of Anne-Arundel coun-
ty, are hereby appointed commissioners to fill the vacancies oc-
casioned by the death of George Howard, (of Brice,) and by
the refusal to act of Nehemiah Moxley, with as full powers as
if thev the said Thomas Oliver and Alien Thomas had been o-
riginaily appointed commissioners, in and by virtue of the act
aforesaid.

CHAP. CXXVIIT.
An Act to give the Levy Court of Caroline County certain Discretionary
Powers therein mentioned.
1. Be it enacted by the General Assembly of Maryland,
That from and after the passage of this act, the levy court of Ca-
roline county is hereby authorised and empowered, that if any
person hereafter shall be fined in any of our courts of justice,
or otherwise, for any misdemeanor, and shall be unable to pay
the fine and fees, or give security, and shall be put to prison for
want of security, to levy the amount of said fees on the county,
which levy, when so made, shall entitle the prisoner to his or
her immediate discharge, provided he or she shall pay the fine,
or be legally discharged therefrom.

2. And be it enacted, That if in the recess of the said levy
court the said prisoner shall obtain, from under the hands of a
majority of said court, that they will levy the said fees at their
next session, such certificate shall be binding on said court, or
their successors, and shall entitle the prisoner to his or her im-
mediate discharge, under the proviso contained in the first sec-
tion of this act.

CHAP. CXXIX.
An Act to prevent the going at large of Swine in the Town of Rockville in
Montgomery County.
|

1. Be it enacted by the General Assembly of Maryland,
That from and after the first day of April, in the year of our
Lord one thousand eight hundred and twenty-seven, no swine
shall be suffered to go at large in the town of Rockville, in
Montgomery county, or within one quarter of a mile thereof;
and if any person shall find in the said town, or within one
quarter of a mile thereof, any swine going at large, it shall and
may be lawful for him, any such swine to kill or impound, or
cause to be killed or impounded.

2. And be it enacted, That it shall be the duty of the bailiff
and constable appointed for said town, and each of them, upon
their own view of swine going at large in the said town, or
within one quarter of a mile thereof, or notice thereof given to
them, or either of them, to kill and destroy such swine, and
for refusal or neglect so to do, the officer so refusing or neglect-
ing shall forfeit and pay the sum of ten dollars for each offence,
to be recovered by warrant before a justice of the pdace as
small debts are now recovered, one half thereof to go to the
person suing for the same, the other half to bo paid to the col-
