SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect June 1, 1990.

AN ACT concerning

University of Maryland Medical System Corporation - Pensions

FOR the purpose of adding certain employees of the University of Maryland Medical
System Corporation to the group of personnel for which the Medical System
Corporation is considered to be a municipal corporation for purposes of
participation in the Employees' Retirement System or the Pension System for the
Employees of the State of Maryland.

BY repealing and reenacting, with amendments,
Article 73B - Pensions
Section 163(e)(3)(xv)
Annotated Code of Maryland
(1988 Replacement Volume and 1989 Supplement)

Preamble

WHEREAS, The University of Maryland Medical System Corporation (UMMS)
is a private, not for profit corporation that was established pursuant to Chapter 288 of
the Acts of 1984; and

WHEREAS, As a result of Chapter 288 of the Acts of 1984, a dual personnel
system was created that requires UMMS to use both noncorporation ("University")
personnel and corporation ("Corporation") employees; and

WHEREAS, Funds were included in the Fiscal Year 1989 State Budget to
implement a voluntary transfer incentive program under which most UMMS University
employees transferred to the Corporate personnel system while continuing to
participate in and remain members of the Maryland State Retirement and Pension
Systems; and

WHEREAS, The few remaining UMMS University employees should have the
option to become Corporation employees, while also continuing to participate in and
remain members of the Maryland State Retirement and Pension Systems under the
same terms and conditions that they presently enjoy; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
