163.

(e) (3) To participate in the Employees' Retirement System or the Pension
System for the Employees of the State of Maryland the following entities shall be
considered to be a municipal corporation:

(xv) The University of Maryland Medical System Corporation as
defined in § 13-lB-01(n) of the Education Article, but only for [medical]:

1. MEDICAL system University personnel who were

employees of the University of Maryland on June 30, 1988, who were members of the
Employees' Retirement System or the Pension System for the Employees of the State of
Maryland, and who became Medical System Corporation employees on or before July 1,
1988; AND

2. MEDICAL SYSTEM UNIVERSITY PERSONNEL WHO

WERE EMPLOYEES OF THE UNIVERSITY OF MARYLAND ON JUNE 30, 1990,
WHO WERE MEMBERS OF THE EMPLOYEES' RETIREMENT SYSTEM OR
THE PENSION SYSTEM FOR THE EMPLOYEES OF THE STATE OF
MARYLAND, AND WHO VOLUNTARILY BECAME MEDICAL SYSTEM
CORPORATION EMPLOYEES ON OR BEFORE JULY 1, 1992 1991.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1990.

AN ACT concerning

Nonprofit Health Service Plans and Preferred Provider Organizations - Regulatory

Authority

FOR the purpose of clarifying and revising the regulatory authority of the Insurance
Commissioner over preferred provider organizations, preferred provider
insurance policies, and provider service agreements; requiring that certain
insurers file certain documents upon request of the Insurance Commissioner;
altering certain provisions regarding the reimbursement of certain providers from
an aggregate to an individual basio; granting certain regulatory powers of the
Insurance Commissioner relating to nonprofit health service plans; subjecting
nonprofit health service plans to prohibitions against unfair claims settlement
practices; providing that certain provisions of law do not apply to the participating
provider contracts of a nonprofit health service plan if they are regulated under
cortain other provisions of law; repealing or transferring certain provisions of law
