Mr. Kimmel submitted the following:

Ordered, That it be entered on the Journal that the Senator
from Frederick county moved to strike out the word "white,"
in section —, of the bill relating to free negroes, in recognition
of the principles of law enunciated by the Supreme Court of the
United States in the Dred Scott case.

Mr. Yellott moved to lay the order on the table.

Mr. Stone moved to adjourn.

Mr. Yellott moved a call of the Senate-

The President decided the call out of order.

Mr. Yellott appealed from the decision of the President.

The yeas and nays being demanded, appeared as follows :

AFFIRMATIVE.

Messrs. Bradley, Lynch,

Duvall, Nuttle,

Franklin, Smith,

Gardiner, Stone,

Kimmel, Townsend—10.

NEGATIVE.

The question was then taken upon the motion to adjourn.
