Repealed.
|
ter four hundred and sixty-two of the acts
passed at the January session, eighteen hun-
dred and seventy-eight, entitled an act to en-
able the qualified voters of certain election,
districts of Dorchester county to determine
by ballot whether spirituous or fermented
liquors shall be sold in said district or a
license granted for sale of the same therein,
be and the game is hereby repealed, and the
following section is enacted in lieu thereof :
SEC. 5. And be it enacted, That if any per-
son or persons, firm, company, club or body

corporate shall in any election district of Dor-
chester county, wherein a majority of the votes
as aforesaid have been cast "against license,"
sell or otherwise barter, dispose of, directly or
indirectly, or take orders for the same to be
delivered in future, any spirituous or fer-
mented or other intoxicating liquors or medi-
cated bitters producing intoxication, or any
compound of which alcohol forms the chief or
principal ingredient as aforesaid, and except
as aforesaid, he, she or they shall be deemed
guilty of a misdemeanor, and on conviction
thereof shall be fined not less than fifty nor
more than three hundred dollars, and be im-
prisoned in the House of Correction not less

than three months nor more than six months,
in the discretion of the Court, for each and
every offence; and the person or persons in
possession of the premises, house or place at
the time the violation occurred, shall be
deemed "prima facie" guilty of a misde-
meanor, and on conviction thereof shall be
subject to the same fines and penalties as the
actual violator of this act.

Effective.
|
SEC. 2. And be it enacted, That this act shall
take effect from the date of its passage.
