hazardous to persons traveling upon said streets
and crossing said railroad; and, whereas acci-
dents have happened at said crossings because
of there being no signals of the approach of
trains on said railroad as aforesaid; therefore,.
SECTION 1. Be it enacted by the General As-
sembly of Maryland, That the Baltimore &
Ohio Bailroad Company be and it is hereby
required to keep a flagman or signalman sta-
tioned during each and every day from five
o'clock a. m. to ten o'clock p. m. from the first
of March to the first of November, and from
six o'clock a. m. to ten o'clock p. m. from the

first of November to the first of March, in each
and every year, at each of the crossings of its
said railroad over Frederick avenue and over
. Chestnut street, in the town of Gaithersburg,
in Montgomery county, to warn persons using
said streets and crossing over said railroad at
said crossings of the approach of trains upon,
said railroad.
SEC. 2. And be it further enacted, That the
said Baltimore & Ohio Railroad Company shall
be liable to pay a fine of fifty dollars for each
and every day that the said company shall fail

or neglect to comply with the provisions of
this act after the fifteenth day of April, in the
year eighteen hundred and eighty-six, said
fine to be recovered in an action of debt in the
name of the State of Maryland before any
Justice of the Peace in and for Montgomery
county; said fine to be paid, when collected, into
the Public School fund of Montgomery county.

Effective.

SEC. 3. And be it further enacted, That this
act shall take effect from the date of its pas-
sage.
