day they may be in session or attending to their
public duties; provided, the entire sum paid
to a member in any one year shall not exceed
twenty-four dollars.
SEC. 107. The members of the Council shall
meet at their Chamber on the First Monday in
May in each year to organize, and shall, before
entering upon their duties, make oath before the

Mayor or a Justice of the Peace, that they will
diligently and to the best of their judgment
perform the duties devolving upon them with-
out fear, partiality or prejudice; and the
Mayor shall take the oath prescribed by the
Constitution as directed by article sixty-eight
of the Code; a majority of the members
elected shall be a quorum of the Council.
SEC. 108. The said Council shall meet on the
first Monday of every month, and as much
of tener as they may deem necessary; in organi-
zing they shall elect one of their number to be
President of the Council, whose duty it shall be
to preside over the meetings of the Council, and
in case of the absence of the Mayor, or a vacancy
in that office, he shall act as Mayor, and have

all the powers and privileges attached to the
office until such vacancy is duly filled by elec-
tion; they shall also, at their first regular meet-
ing in May, in each year, appoint and qualify
a Clerk and a Treasurer, the latter of whom
shall have charge of all moneys belonging
to said town, and pay out the funds in his
hands upon the order of the Mayor and Coun-
cil, and all moneys belonging to said town
shall be paid over to said Treasurer, and to no
other person, and no other officer of said town
shall pay any money, draft or obligation of
said town.

SEC. 109. The Mayor shall, ex officio, have
all the powers of a Justice of the Peace in
cases where the town is a party, and an appeal
may be taken from his judgment to the Cir-
cuit Court for Garrett county in the same
