waters of said county with scoops or dredges,
without first having obtained license as here-

inbefore provided, or any managing owner
who shall have fraudulently obtained said
license, shall be deemed guilty of a misde-
meanor, and upon conviction before a Justice
of the Peace or Judge of the Circuit Court for
said county, shall be fined not less than one
hundred dollars nor more than two hundred
dollars, and stand committed until fine and
cost are paid, or imprisoned in the House of
Correction for a period of not less than three
months nor more than one year.
SEC. 7. And be it enacted, That any person
or persons who shall use any boat, canoe or
vessel to catch oysters with scrapes or dredges,
in any of the waters of said county not author-
ized by this act, or refuse to exhibit the Custom
House and dredging license whenever called for
by any officer of the State of Maryland, or
for catching oysters before the season com-
mences, or after it has closed, or for any
other violation of this act, the penalty for
which is not otherwise provided for, shall,
upon conviction thereof before a Justice of
the Peace or Judge of the Circuit Court of
Dorchester county, upon indictment by the
Grand Jury, be fined not less than fifty dollars
nor more than one hundred dollars, and stand

committed until the costs and fines are paid ;
provided, that before a Justice of the Peace
shall proceed to try any case under this act,
he shall require the person or persons charged
with such violation to make his or their elec-
tion either to be tried before said Justice or
before the Circuit Court for Dorchester county,
and said election shall be entered upon the
record of the said Justice, if he or they elect
to be tried before the Circuit Court, he, or
each of them, shall be required to give bond,
with approved security, to the State in double
the amount of the fine named in this act for
said offence for his or their appearance at the
