every owner of a boat shall pay two dollars,
per ton for every ton said boat shall measure;
provided, that all boats measuring less than
five tons, shall pay eight dollars for said
license.

SEC. 5. And be it enacted, That the manag-
ing owner of such boat shall make oath or
affirmation before the said Clerk, that he is-
