to catch oysters with scoops or light dredges ;
and said Examiner as soon as notified and paid
two dollars and traveling expenses, if any, by
the managing owner of said boats, proceed to
examine said boat, and shall report without
unnecessary delay in writing under oath to
said Clerk, and his report shall be filed in the
Clerk's office; if the report states the boat con-
tains dunnage, or contained dunnage when
measured by Custom House Measurer, the said
Clerk shall not issue license for said boat to
take or catch oysters with scrapes or light
dredges, but the owner may remove all of said
donnage, and again have said boat remeasured
by the proper Custom House Measurer, and ex-
amined by the Examiner, and if under ten

tons, and if all other requirements and con-
ditions hereinafter provided, shall be complied
with, the Clerk shall issue license for said
boat; provided, that this section shall not
apply to boats licensed previous to the pas-
sage of this act, to take or catch oysters with
scrapes or dredges in said waters; but this
provision shall not be so construed as to make
it lawful for any boat, over ten tons, Custom
House measurement, to be used in taking or
Catching oysters with scoops or dredges in the
waters of said county.

SEC. 4. And be it enacted, That the Clerk of
the Circuit Court for Dorchester county shall,
upon the application of the managing owner,
who has been a resident of said county for
twelve months next preceding such applica-
tion, and to no other person, issue a license to
such resident, to employ his boat of a capacity
of ten tons or under in taking or catching
