serve until the second Monday of May, eigh-
teen hundred and eighty-eight, and until their
successors shall be elected and qualified; and
a failure to qualify within fifteen days after
their election, shall be deemed a refusal on
the part of the party or person so failing to
accept the office to which he has been elected.
SEC. 5. And be it enacted, That if any person
so elected either as Mayor or Common Coun-
cilman, shall refuse to serve as such, or his

tion, disqualification or otherwise, the Com-
mon Councilmen, or a majority of them, in
the event of any vacancy of the Mayoralty as
above provided, shall fill such vacancy as
early as possible from among the qualified

pointed to fill said vacancy shall hold the
office until the next election; and in the event

without favor, partiality or prejudice, and a
certificate of such qualification shall be made

ings of said corporation.
