ing to act, and the remaining twelve shall con-
stitute the Jury, and the Sheriff qualify the
said twelve Jurors, either by oath or affirma-
tion, as the case may be, justly, truly and im-
partially to estimate the value of the damages
which may be sustained by the owner or own-
ers of the land or water-right required; and
the said Jury in estimating the damages sup-
posed to be sustained by the said owner or
owners of the land or water-rights required,
shall take into the estimate the benefit result-

ing to the said owner or owners, but only in
extinguishing or lessening the claim for dam-
ages; and the said Jury shall reduce their ver-
dict to writing, and sign and seal the same, and
it shall then be returned by the Sheriff to the
Clerk of the Circuit Court for Wicomico or
for Worcester county, as the case may be, and
if no good or sufficent reason shall be shown
against said verdict it shall be confirmed by
the Court at the next term succeeding the re-
turn of said verdict; but if the said verdict
shall be set aside by said Court, the said Court
shall then direct another inquisition to be
held in the manner before described, and when
the verdict is confirmed and the valuation paid
or tendered to the owner or owners, or their
agents or representatives, or paid into the said
Court, the said company shall be entitled to
the estate and interest therein as fully as if
conveyed by the owner or owners; and the said
verdict shall be recorded among the land
records of Wieomico or of Worcester counties

in whichsoever the land or water-rights ac-
quired may be located, at the expense of the
company; and whenever it becomes necessary
to hold any inquisition as herein provided on
any lands or water-rights, as aforesaid, the
company may enter upon, occupy and use the
same immediately after the same shall have
been viewed by the said Jury and confirmed
by said Court, and the said company shall have
paid or tendered the owner or owners of the
land or water-rights condemned the damages
awarded by said Jury.
