SEC. 5. And be it enacted, That the President
and Directors of said company may agree
with the owner or owners of any real estate or
water-rights in the bed, or on the borders of
said river, for the use and occupation of the
same in making said channel or canal and
wharves, and for the protection of the same
from any injury whatsoever; and in case they
cannot agree, or if the owner or owners thereof
shall be a feme covert, a minor, non compos
mentis, or non-resident, upon application to a
Justice of the Peace for Wicomico county or
for Worcester county, he shall issue his war-
rant, under his hand and seal, directed to the
Sheriff of his respective county, requiring him
to summon a jury of twenty competent and
disinterested men, residents of the county in
which the real estate or water-right to be
valued is located, to meet on the land or
premises to be valued on a day that shall be
named in said warrant, not less than ten
nor more than thirty days after issuing the

not attend the Sheriff shall instanter, sum-
mons as Jurors an many more residents of his
county as may be necessary with those in at-
tendance to furnish a panel of twenty Jurors,
and from them for each party, his, her or their
