AN ACT to add a sub-section to section one of an act
|
|
|
|
|
passed at the January Session, A. D. eighteen hun-
|
|
|
|
|
dred and eighty-two, chapter four hundred and
|
|
|
|
|
eighty-three, entitled " An act to repeal section one
|
|
|
|
|
of chapter two hundred and forty-four of the act
|
|
|
|
|
passed at the January session of eighteen hundred
|
|
|
|
|
and eighty," entitled "An act to regulate Fences
|
|
|
|
|
in the Third election or Vienna District of Dor-
|
|
|
|
|
chester county, and to re-enact the same with
|
|
|
|
|
amendments, so as to include part of district num-
|
|
|
|
|
ber one, or The Fork.
|
|
|
|
|
SECTION 1. Be it enacted by the General Assembly
|
|
|
|
|
of Maryland, That section one of chapter four hun-
|
|
|
|
|
dred and eighty-three of the acts passed at the January
|

|
session eighteen hundred and eighty-two be amended
|
|
|
|
|
by adding a sub-section thereto to be designated as
|
|
|
|
|
sub-section A.
|
|
|
|
|
SUB-SEC. A. And be it enacted. That if the assessors
|
|
|
|
|
appointed under said section one shall certify in

writing to the justice of the peace hearing the com-

|
|
|
plaint under said act, that said fence or fences, at the
|
|
|
|
|
particular point or place, through or over which any
|
|
|
|
|
live stock may have broken or trespassed, is of the

|
|
height and sufficiency required in said section one, or
|
|
|
|
|
is or has been freshly broken, then damages shall be

awarded to and recoverable by the owner or owners

as required in said section one.

SEC. 2. And be it enacted, That this act shall take
