Chapter 358.

AN ACT to add a supplement to an act entitled "An
|
|
|
|
|
act to incorporate a company to construct a turn-
|
|
|
|
|
pike road from Hagerstown, in Washington county,
|
|
|
|
|
to the town of Sharpsburg," passed at the January
|
|
|
|
|
session, eighteen hundred and fifty-three, chapter
|
|
|
|
|
one hundred and twenty-nine.
|
|
|
|
|
SECTION 1. Be it enacted by the General Assembly
|
|
|
|
|
of Maryland, That it shall be lawful for the Hagers-
|
|
|
|
|
town and Sharpsburg Turnpike Company, and said
|
|
|
|
|
company is hereby authorized and empowered to erect
|

upon their road a tollgate at any point on said road

|
|
|
|
south of the point where the road leading from

|
|
|
|
Keedysville, in said county, joins with the road of the
|
|
|
|
|
Hagerstown and Sharpsburg Turnpike Company, and

|
|
|
not nearer to the town of Sharpsburg than three-quar-
|
|
|
|
|
ters of a mile; and they are hereby empowered and
|

directed to remove the present tollgate upon the

south end of said road, should they avail themselves
|
|
|
|
|
at any time of the powers and privileges contained in
|
|
|
|
|
this act.

|
|
|
SEC. 2. And be it enacted, That the said Hagers-
|
|
|
|
|
town and Sharpsburg Turnpike Company shall not
|
|
|
|
|
charge at its tollgate which may be located south of the
|
|
|
|
|
point of the joining of the said road leading from Kee-
|
|
|
|
|
dysville with the road of the Hagerstown and Sharps-
|

burg Turnpike Company, more than one-half of the
|
|
|
|
|
usual and customary rate of toll upon all travel
|
|
|
|
|
through said gate located as aforesaid, which turns
|
|
|
|
|
upon the aforesaid road leading from Keedysville, or
|
|
|
|
|
comes from the aforesaid road leading from Keedys-
|
|
|
|
|
ville.

|
|
SEC. 3. And be it enacted, That all parts of section
|
|
|
|
|
seven of chapter one hundred and twenty-nine of the
|
|
|
