AN ACT to add a new section to article thirty of
|
|
|
|
the Code of Public General Laws of the State of
|
|
|
|
Maryland, title " Crimes and Punishments," relat-
|
|
|
|
ing to the fraudulent removing, secreting, destroy-
|
|
|
|
ing or selling of mortgaged personal property by
|
|
|
|
the mortgagor thereof.
|
|
|
|
SECTION 1. Be it enacted by the General Assembly
|
|
|
|
of Maryland, That the following section he added to

title " Crimes and Punishments :"
|
|
|
|
75 B. A mortgagor of personal property, in posses-
|
|
|
|
sion of the same, who, without the consent of the
|
|
|
|
owners of the claim, secured by said mortgage, first
|
|
|
|
had and obtained in writing from said owner, and
|
|
|
|
with intent to defraud, removes any of the property
|

mortgaged out of the county or city where it was
|
guilty of a mis-
|
|
|
situated at the time it was mortgaged, or secretes,
|
demeanor.
|
|
|
destroys or sells the same, shall be deemed guilty of a
|
|
|
|
misdemeanor, and on indictment therefore, and con-
|
|
|
|
viction thereof, shall be fined not more than five hun-
|
|
|
|
dred dollars, or imprisoned in jail not more than six
|
|
|
|
months, or both, in the discretion of the court.
