CHAPTER 428.

AN ACT to repeal Section 176 of Article 48A of the An-
notated Code of Public General Laws of Maryland, Edi-
tion of 1924, title "Insurance, " sub-title "Fraternal Bene-
fit Associations. "

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 176 of Article 48A of the Anno-
tated Code of Public General Laws of Maryland, title "In-
surance, " sub-title "Fraternal Benefit Associations, " be,
and the same is hereby repealed.

Approved April 21, 1933.

CHAPTER 429.

AN ACT to repeal and re-enact, with amendments, Sec-
tion 78 of Article 48A of the Code of Public General
Laws of Maryland, title "Insurance, " sub-title "Fire In-
surance, " as enacted by Chapter 492 of the Acts of 1922,
relating to penalties for evasion of payment of tax on
unauthorized insurance.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 78 of Article 48A of the Code of
Public General Laws of Maryland, title "Insurance, " sub-
title "Fire Insurance, " as enacted by Chapter 492 of the
Acts of 1922, be and the same is hereby repealed, and re-
enacted, with amendments, so as to read as follows:

Section 78. Penalties for Violation of Sections 74, 75,
76 and 77. Any person who shall, with intent to avoid
the payment of the tax on insurance in unauthorized com-
panies as provided by Section 75, make a false affidavit,
shall be guilty of perjury and shall be proceeded against
and punished as provided by the statutes of this State in
relation to the crime of perjury, and any policy of insur-
ance obtained by means of such false affidavit shall be void,
and the license or authority for such unauthorized insur-
ance shall be cancelled by the Commissioner. The obtain-
ing or possession of any such policy insuring against loss
on property situated in this State issued by com-
