or petitioners shall apply for a license to do business, stat-
ing the full name, residence or place of business of each
person certifying that they have been acquainted with the
petitioner for one year preceding said application for said
license, and that they have good reason to believe and do
believe that all the statements contained in said petition
are true and that they, therefore, pray that the prayer of
said petitioner be granted, and that the license be issued
as prayed for.
316G. Immediately upon receipt of said application,
the Clerk of the Circuit Court shall cause a notice of the
application for said license to be advertised at least two
times during the period of one week in some daily news-
paper published in Allegany County.
On or before the expiration of said period of one week,
any three or more reputable citizens, voters and taxpayers
residing in the neighborhood in which the business sought
to be licensed is to be carried on, or the State's Attorney
for Allegany County, or in the event said place of business
is located within an incorporated town or city, then the
governing officers of said municipal corporation may file
with the Clerk written objections to the granting of such
license which shall be verified by the oath of said remon-
strants. The following grounds shall be the sole basis for
a remonstrance against the issuance of said license:
(a) That the same is not necessary for the accommoda-
tion of the public;
(b) That the applicant is not a fit person to receive such
license; provided that in determining fitness, the Court
shall not consider any prior convictions of the applicant
of the liquor laws of the United States, State of Maryland,
Allegany County, or its municipalities occurring prior to
January 1, 1933.
(e) That said applicant has made a material false state-
ment in his application;
(d) That the place for which said license is applied is
not a proper one with reference to the public peace and
general welfare of the neighborhood or to the character of
its inhabitants, due regard being given to the number of
said licenses issued for said neighborhood.
If such remonstrance is filed, the said Clerk shall not
issue said license, but the application, objections and other
papers or documents appertaining thereto shall be forth-
with submitted to the Circuit Court for Allegany County
and said Court shall fix a day as early as practicable when
