208. Each person owning or operating any such motor
vehicle in violation of any of the provisions of this sub-
title, or in violation of the rules and regulations aforesaid
of the Public Service Commission or the Commissioner of
Motor Vehicles or the State Roads Commission, shall be
deemed guilty of a misdemeanor and upon conviction sub-
ject to a fine of not less than five ($5. 00) dollars nor more
than one hundred dollars ($100. 00) for the first offense,
and a fine of not less than fifty dollars ($50. 00) nor more
than two hundred dollars ($200. 00) for each additional
offense or subsequent offense, with the exception of Sec-
tion 203 which is therein specially provided for.
209. All Acts or parts of Act inconsistent herewith,
are hereby repealed to the extent of their inconsistency,
but nothing herein shall be construed to relieve any owner
or operator of such motor vehicles as are herein
designated from any regulation otherwise imposed by law
or lawful authority.
SEC. 2. And be it further enacted, That this Act shall
not apply until January 1, 1934, to any motor vehicle for
which the Public Service Commission of Maryland has
issued a certificate of public convenience and necessity
for the year 1933.
SEC. 3. And be it further enacted, That should any sec-
tion, or part of a section of this Act be held to be invalid
for any reason, such holding shall not be construed as
affecting the validity of any remaining section or part of
a section of this Act, it being the legislative intent that the
remainder of this Act shall stand, notwithstanding the
invalidity of such section or part of a section.
SEC. 4. And be it further enacted, That this Act is an
emergency law and necessary for the immediate preserva-
tion of the public health and safety, and for maintaining
the State Government, and having been passed by a yea
and nay vote by three-fifths of all the members elected to
each of the two Houses of the General Assembly, the same
shall take effect from the date of its passage.
