the said capital and surplus, otherwise than is authorized in
Section 70 of this Article, they shall be jointly and severally
liable to the creditors of the corporation at the time of
declaring such dividends to double the amount thereof.

SEC. 4. And b e it further enacted, That this Act is here-
by declared to be an emergency law and necessary for the
immediate preservation of the public health and safety,
and having been passed upon a yea and nay vote, supported
by three-fifths of all of the members elected to each of the
two Houses of the General Assembly, the same shall take
effect from the date of its passage.

CHAPTER 529.

AN ACT to repeal and re-enact, with amendments, Section
9 of Article 11 of the Annotated Code of Public General
Laws of Maryland, title "Banks and Trust Companies, "
sub-title "Bank Commissioner"; to add five new sections
to said Article, one of said sections to follow immedi-
ately after Section 8, to be known as Section 8A, and the
remaining four new sections to be added immediately
after Section 9, to be known as Sections 9A, 9B, 9C and
9D, and to repeal Section 61 of said Article, prescribing
the conditions under which banking institutions may be
closed, regulating the appointment of receivers for such
institutions, and defining the powers and duties of such
receivers, and authorizing the reopening or reorganiza-
tion of such institutions.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 9 of Article 11 of the Annotated
Code of Public General Laws of Maryland, title "Banks and
Trust Companies, " sub-title "Bank Commissioner, " be and
the same is hereby repealed and re-enacted, with amend-
ments, to read as follows:

9. Whenever it shall appear to the Bank Commissioner,
upon examination, that any banking institution doing
business under this Article is conducting its business in
an unsafe or unauthorized manner or in conflict with this
article, or if any such institution shall refuse to submit
