Sec. 7. And be it enacted, That the Sheriff shall
make return of the inquisition so found to the
Clerk of the Circuit Court, who shall file the same
and lay it before the said Court at its next session,
and such inquisition shall be confirmed by said
Court, unless good cause be shown to the contrary,
and when confirmed, shall be recorded by the
Clerk at the expense of the Company.

Sec. 8. And be it enacted, That if any damage
shall be awarded to any person by the inquisition,
the corporation shall pay the amount thereof be-
fore proceeding to erect any bridge, embankment,
or abutments.

take effect from the date of its passage.

CHAPTER 41.

 

AN ACT to amend an Act incorporating the
Western Maryland Railroad Company.

Passed Feb.
3, 1866.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the President and Directors of
the Western Maryland Railroad Company, or a
majority of them, be and they are hereby author-
ized to issue the bonds of said Company to the
amount of three million five hundred thousand
dollars, bearing an interest of six per cent, per
annum, payable semi-annually, redeemable in the
year nineteen hundred, and they shall be author-
ized to secure the said bonds by a first mortgage
upon the road between Hagerstown and Cumber-
land, or any point west of Cumberland, within the
limits of the State to which said road may be con-
structed, and also upon its tolls and revenues de-
rived from such portion of its road.
