Proviso.
|
Bridge subscribed for by said County Commission-
ers; provided, the whole number of directors elected
by said County Commissioners, shall not exceed
three; all other directors in said Company shall he
stockholders therein, unless the State of Maryland,
under the provisions. of the Act of eighteen hun-
dred and forty, chapter three hundred and three,
shall pay a portion or all the money therein men-
tioned to he paid to said Company, in which case
one of said directors shall have such qualifications
and be elected in such manner as the said State
shall direct.

Sec. 4. And be it enacted, That section nine of
said Act, be and same is hereby repealed, and that
the County Commissioners of Cecil county, may
subscribe for such portion of the stock of said
Company not exceeding ten thousand dollars as
they may deem advisable, and for the interest of
said county, the sum so subscribed to be raised in
the usual way by levy upon the assessable property
of said county.

Valuation of
materials.

Sec. 5. And be it enacted, That in the event of
the failure of the said Company to agree with the
owner or owners of any land required for the uses
of said bridge, or for the purpose of obtaining dirt,
clay, or gravel for any embankments deemed by
said Company necessary or advisable about said
bridge, the said Company shall apply to a Justice
of the Peace in the district of said county where
such land lies, who shall thereupon issue his war-
rant directed to the sheriff of the said county, com-
manding him to summon twelve disinterested per-
sons qualified to serve as jurors, to meet at the
proper place as directed by said Justice, and the
Sheriff shall qualify the said persons by oath,
faithfully to perform the duties required of them
by the next preceeding section.

Appraisal,

Sec. 6. And be it enacted, That the said jury shall
make a just and equitable appraisal of all the loss
or damage that may be sustained by any person
over whose land said bridge, embankments, or
abutments are intended to be placed, or whose
land may be taken to furnish dirt, clay, or gravel
for any embankment deemed necessary by the
Company, and to make a true return and inquisi-
tion thereof under their hands and seals.
