timore, any Justice of the Peace of said city,
and the Sheriff thereof, and jurors to be summon-
ed from among the inhabitants of said city, and the
Superior Court, of Baltimore city, and the clerk
thereof, and all persons interested in the exercise
of the said powers, shall have the same rights and
privileges, as were conferred by said original Act
of incorporation, upon any Justice of the Peace of
any county in the State; and upon the Sheriff of
any county, and upon jurors to be summoned from
the inhabitants of any county, or upon any clerk
of any court in relation to the road of the said

Company; provided, nevertheless, That the said
Company in changing the location of any part of
its road or branches, as aforesaid, shall not be au-
thorized to abandon the use of that part of the
road formerly located, but shall continue to use the
same, except where said abandonment is necessary;
and provided, also, that the said Company shall,
in altering the location of its road as aforesaid,
within the city of Baltimore, so construct and
make such line of newly located road as not to in-
terfere with the free use of the streets of the said
city, or with traveling thereon; and provided, also,
that the said newly constructed Railroad shall not
be laid along the length of any street, lane or al-
ley of said city, without the consent of the Mayor
and City Council, of Baltimore, thereto, being first
had and obtained.

Sec. 2. And be it further enacted, That this act
shall take effect from its passage.
