ject to the inspection of all persons interested; they
shall also at their first meeting, or as soon there-
after as possible, appoint a bailiff for said town,

 

from the qualified voters of said town; provided,
however, that they may appoint the Constable of
the second election district of Caroline county, if
he should be a resident of said town, or will reside
therein after his appointment as bailiff.

Proviso.

Sec. 5. And be it enacted, That before the bailiff
shall enter upon the duties of his office he shall
make oath before a Justice of Peace of Caroline
county, that he will faithfully and impartially per-
form the duties of bailiff and constable within said
town, according to the best of his skill and judg-

ment; and shall also give bond in the same penalty
and to be in all respects liable as the constable's bond
of said county, with good and sufficient security to
be approved by the County Commissioners, condition-
ed that he will well and faithfully execute the
said office in all things appertaining thereto, and
shall also well and truly account for all moneys
placed in his hands for collection, and shall -well
and truly pay all sums of money received by him
over to the treasurer of said Board of Commis-
sioners.

Bond.

Sec. 6. And be it enacted, That the bailiff shall
collect all taxes levied by the Commissioners, and
pay the same to the treasurer, and if any person
shall neglect or refuse to pay any taxes, or any fines
or forfeitures, due by him, her or them, the bailiff
may collect the same, in the same manner as county
taxes are collected, and if there be any real or per-
sonal property in Denton, the owner of which
resides in another county or State, the Commis-
sioners may order the bailiff to sell so much there-
of as will pay the sums due by such owner for
taxes, fines or forfeitures, but before selling the
property of any non-resident the bailiff shall call
on the tenant, if any, on the property, to pay the
taxes, fines, penalties or forfeitures due by the
owner, and on his failure to pay the same, the
Commissioners shall give notice in some newspaper,
if any printed in the county, where the owner resides
at least three weeks before the day of sale; the
bailiff shall also attend the meetings of the Com-
missioners, when so required, and perform such
service as shall be by them directed; he shall pre-
