first meeting one of said commissioners shall be
elected president of the board.

held.

Sec. 3. And be it enacted, That the election for said
commissioners shall be held between the hours of
two and four o'clock, P. M., of the said first Mon-
day in April, annually, as aforesaid, by a judge
who shall be appointed by the commissioners in
office, which said judge, before he opens an elec-
tion, shall take an oath before a Justice of the
Peace, that he will faithfully and impartially per-
mit every person to vote at the election, who shall
be qualified to vote for a commissioner of said
town, and that he will not permit any person
to vote at such election who shall not, in his judg-
ment, be qualified to vote, and should any vacancy
occur in the office, of one or more of the commis-
sioners, by death, resignation, removal or other-
wise, the remaining commissioners shall cause an
election to be held at such public place in said
town as they shall appoint, by the persons qualified
to vote, to fill such vacancy, of which said election
ten days previous notice shall be given, and if at any
time an election shall not be had for commission-
ers at the time spoken of in the second section, an
election may be made at any time, after ten days
notice thereof shall have been given by the com-
missioners or a majority of them.

Sec. 4. And be it enacted, That every commis-
sioner before entering upon the duties of his office,
shall take an oath before some Justice of the Peace
that he will diligently and faithfully, according to
the best of his judgment perform the duties of
commissioner of the said town, without favor, par-
tiality or prejudice, and a certificate of such quali-
fication shall be returned by the Justice to the
