CHAPTER 115.
AN ACT supplementary to an act authorising the
transcribing of certain records of indexes in the
office of the Register of Wills for Frederick
County, passed by the General Assembly of Ma-
ryland, at its January Session, eighteen hun-
dred and fifty-eight, chapter twenty-eight.

Proviso.
|
WHEREAS, By an act of the General Assembly
of this State, passed at its January session, eigh-
teen hundred and fifty-eight, chapter twenty-eight,
the Register of Wills, for Frederick county, was
required to transcribe certain indexes of records, and
to make certain other new indexes of records in said
office, and the annual cost and expense thereof was
required to be paid by said Register of Wills ont of
the surplus fees of his office, when any surplus ex-
isted, and when no surplus existed, by the county
commissioners for Frederick county; and whereas,
the said county commissioners, in carrying out the
provisions of said act of Assembly have paid to
said Register of Wills large sums of money during
years when the fees of his said office were inade-
quate to pay the annual cost and expense of pre-
paring said indexes, and it is right and proper that
the sums of money so advanced should be refunded
to said county commissioners out of the surplus
fees of the office of said Register of Wills, when
any surplus exists; Therefore,

paid over.

SECTION 1. Be it enacted, by the General Assembly
of Maryland, That the Register of Wills for Fred-
erick county, and his successors in office, are hereby
required to make to the county commissioners for
Frederick county the annual report of the receipts
and expenses of their said office, and to pay over
to said county commissioners any surplus of fees
that may be in their hands, until the amounts so
expended by said county commissioners shall be
refunded to them.

Sec. 2. And be it enacted, That this act shall
take effect from the date of its passage.
