SECTION 1. Be it enacted by the General Assembly
of Maryland, That the Clerk of the Circuit Court
for Washington county, shall grant no license to
any person for the sale of spirituous or fermented
liquors of any kind at any time, or at any place
within three miles of that portion of the line of
Washington County Railroad, between Hagers-
town and its terminus at Knoxville, for and during
the period of time necessary for its construction,
and any person selling any kind of intoxicating
drinks, whether of original manufacture or of a
mixed character, within the above described limits,
shall, on conviction, be subject to all the fines and
penalties prescribed by the Code of Public Laws of
Maryland for selling spirituous or fermented liquors
without license.

Sec. 2. And be it enacted, That this act shall not
apply to a removal of license to any regular and
well-conducted hotel, tavern or inn, that may have
been, previous to the passage of this act, licensed
and kept as such within the limits described in the
first section of this act.
