CHAPTER 73.

AN ACT to amend article twenty-one of the Code
of Public Local Laws of Washington county,
by adding thereto additional sections authoriz-
ing the Mayor and Council of Hagerstown, to
lay out and open streets and alleys in said town.

SECTION 1. Be it enacted ty the General Assembly
of Maryland, That the following sections be added
to article twenty-one of the Code of Public Local
Laws for Washington county, to come in after sec-
tion one hundred and twenty-three of said article:

124. That the Mayor and Council shall have
power to provide for laying out, opening, and ex-
tending any street or alley within the town, which
in their opinion the public welfare or convenience
may require; to provide for ascertaining whether
any, and what amount in value of damage will be
caused thereby, for which the owner or possessor
of any property through which such street or alley
may pass, ought to be compensated, and for assess-
ing and levying, either generally on the whole as-
sessable property with the town, or specially on
property of persons benefitted, the whole or any
part of the damages and expenses which will be
incurred in laying out or extending such street or

alley; for granting appeals to the Circuit Court
for Washington county, from the decisions of any
commissioners or other persons appointed in virtue
of any ordinance, to ascertain the damage occa-
sioned by the opening or extending of such street
or alley, and for securing to the person injured the

return of the report of the commissioners, to have
decided by a jury trial whether any and what dam-
