revenues; the said mortgage not to have priority
over, hut to stand upon an equality with other
mortgages, to be executed by said company to the
city of Baltimore, and the Commissioners of Alle-
gany county, for like advances in aid of the said

AN ACT to authorize the Mayor and City Council
of Baltimore to aid in the construction of the
Western Maryland Railroad from Hagerstown
to Cumberland.

Authorized
to contribute.
|
SECTION 1. Be it enacted by the General Assembly
of Maryland, That the Mayor and City Council of
Baltimore, be and they are hereby authorized and
empowered to contribute towards the construction
of the Western Maryland Railroad between Ha-
gerstown and Cumberland, the sum of fifteen
hundred thousand dollars, either by a subscription
to that amount to the capital stock of the said com-
pany or by the endorsement of the said company's
bonds or by the issue of the city's own bonds as may
be most expedient in the judgment of the said
Mayor and City Council.

Sec. 2. And be it enacted, That the said Western
Maryland Railroad company, in the event of the
said sum being furnished to the company for the
construction of the road as aforesaid, by the said
Mayor and City Council, in either of the modes
aforesaid, other than by a subscription to its
capital stock, shall be authorized to secure the said
city for the amount so advanced or endorsed by a
mortgage on its road, property, tolls and revenues,
the said mortgage not to have priority over, but
to stand upon an equality with other mortgages,
to be executed by the said company to the coal and
