Chapter 201.

AN ACT to authorize the Commissioners of Ches-
|
 
|
tertown to open, widen or extend streets within
|
 
|
the limits of said town.
|
 
|
SECTION 1. Be it enacted by the General Assem-
|
 
|
bly of Maryland, That the Commissioners of Ches-
|
 
|
tertown are hereby authorized, whenever in their
|

judgment the public convenience requires it, to

widen.

extend or widen any of the streets or alleys within

the limits of said town, and to open such new streets
|
 
|
as they may deem necessary.

|
SEC. 2. And be it enacted, That it shall be lawful

for said commissioners to contract and agree with

for the amount of damages and advantages accruing

to such owner, and to provide for the payment of the

same.

SEC. 3. And be it enacted, That whenever the
|
 
|
said commissioners and owner of any such property
|
 
|
cannot so agree, then said commissioners shall select
|
 
|
some disinterested citizen of Kent county, and such
|
 
|
owner shall select one disinterested citizen of Kent
|
 
|
county, who, if they cannot agree, shall call in a
|
 
|
third citizen of Kent county, and they shall visit
|

the property to be effected by the proposed street,
and assess the damages and advantages which may
|
 
|
accrue to such property or the owner thereof, and
|
 
|
they shall make their award in writing to said com-
|
 
|
missioners and to such owner, and either party .may
|
 
|
appeal from such award to the Circuit Court of
|
 
|
Kent county, provided the opposite party be notified
|
 
|
thereof within thirty days from the date of the
|
 
|
award.
