drawing the same; for every cart or wagon whose

wheels shall exceed in breadth four inches, two

charging all the aforesaid tolls one mule shall be

estimated as equal to one horse, and two oxen as

equal to one horse, provided, that if any wagon or

whose wheels shall not be four inches, shall draw
|
 
|
along or over said road with a greater weight than
|
 
|
three tons, or whose wheels being over four inches
|

in width, shall draw along or over said road with a
|
 
|
greater weight than five tons, the owner or owners
|
 
|
of such wagon or other carriage shall forfeit and
|
 
|
pay to the said company four times the customary
|
 
|
tolls, to be recovered with costs of suit in an action
|
 
|
of debt before any justice of the peace having juris-
|
 
|
diction of the case. And, provided further, that said
|
 
|
company shall be authorized and empowered to
|
 
|
assess annually upon each individual or person

thereof and not passing or going through any of said

toll gates, such sum and amount of money to be paid
|
 
|
quarterly by the person or individual so assessed as
|
 
|
shall be just and reasonable for such use of said road,

and shall have power to collect the same in like
|
 
|
manner as like sums are by law collectable; provided,
|
 
|
nevertheless, that no person in passing to or from a,
|
 
|
funeral, or from one part of his farm to another part
|
 
|
thereof, shall be chargeable with tolls.
