Chapter 144.

 

AN ACT requiring the Baltimore and Ohio Rail-

 

road Company to keep a flagman stationed by day

 

and by night at the crossing of said railroad over

 

the Frederick and Buckeystown Turnpike road,

 

in Frederick county.

 

WHEREAS it is represented to this General Assem-

 

bly that the crossing of the Baltimore and Ohio

 

Railroad over the Frederick and Buckeystown Turn-

 

pike road, near Lime Kiln Station, on said railroad,

 

in Frederick county, is by reason of the absence of

a flagman or other signal of the approach of trains

 

extremely dangerous and hazardous to persons trav-

 

eling upon said turnpike and crossing said railroad,

 

and whereas repeated accidents have happened at

 

said crossing because of there being no signal of the

 

approach of trains on said railroad as aforesaid,

 

therefore —

 

SECTION 1. Be it enacted by the General Assem-

 

bly of Maryland, That the Baltimore and Ohio

 

Railroad Company be and it is hereby required to

 

keep stationed by day and by night at the crossing

 

of its said railroad over the Frederick and Buckeys-

 

town Turnpike road, near Lime Kiln Station, on

 

said railroad, in Frederick county, a flagman or sig-

approach of trains upon said railroad; provided,

 

that in case the said railroad company shall at any

 

time hereafter so change the grade of its road as to

 

run its tracks over or under the said turnpike, then

from complying with the provisions of this act so

SEC. 2. And be it further enacted, That the said

 

Baltimore and Ohio Railroad Company shall be
