indebtedness evidencing such loan, be and it is hereby repealed
and re-enacted, with amendments, to read as follows:
6. The actual cash proceeds of the sale of the certificates of
indebtedness to be issued under this Act shall be paid to the
Treasurer of the State, upon the warrant of the Comptroller,
and such proceeds shall be used exclusively for the following
purposes, to wit:
The Comptroller shall, immediately upon the sale of and
payment for any and all of the certificates of indebtedness
authorized by this Act, first return to and credit the Treasury
for a sum equivalent to the amount expended as provided for
by Section 5 of this Act; the remainder of the proceeds of
said loan shall be credited on the books of the State Treasury
Department to the Board of Public Works in a special account
to be known as the "Emergency Reconstruction Fund", and
shall be turned over to said Board of Public Works from
time to time, whenever and as called for, and shall be used
and expended by the said Board of Public Works for the fol-
lowing purposes: For the construction, reconstruction, replace-
ment and repair of roads and bridges, their approaches and
appurtenances and other public property damaged by flood
during the month of March, 1936, including drainages struc-
tures, retaining walls, dams and other structures or projects
for flood control, or to aid in preventing future similar dam-
age, and for such other uses and purposes in connection there-
with as may be deemed necessary by the Board of Public
Works of the State of Maryland, or to be paid by the Board
of Public Works to any State, Federal or other governmental
agency to be used for the above purposes, subject to the ap-
proval of the Board of Public Works. Any balance of the
proceeds of the sale of the certificates of indebtedness to be
issued pursuant to this Act, remaining in the hands of the
Board of Public Works after the completion of the purposes
above set forth, may be used and expended by the said Board
of Public Works for the construction, reconstruction, replace-
ment and repair of roads and bridges, their approaches and
appurtenances, damaged by storm or flood during any year.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and having
been passed by a yea and nay vote, supported by three-fifths
of all the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date of
its passage.
